 ICBC appealed arguing “the relevant consumer, having the familiarity but imperfect recollection of the ICBC Official Marks, would likely be led to believe that ICBC itself is offering advice on its business, wares and services, when viewing such marks as a matter of first impression”.ICBC  The BC Court of Appeal disagreed and dismissed ICBC’s appeal. Perhaps these changes do not go as far as the Legal Services Act in the UK, but they do represent a break in terms of BC, from the traditional view that only lawyers can be an owner of any entity that delivers legal services (and share in the revenues). [read post]
