In addition to being constitutional rights, (which should count for something), these three types of safeguards serve to ensure accuracy in a guilty verdict (the majority of capital cases are not nearly as clear a guilt question as the Hayes/Komisarjevsky trials), to protect against bias in prosecution and in sentencing, to ensure that a person sentenced to death “deserves” that penalty (as defined by the legislature, no less), to ensure that trials are in fact conducted fairly… [read post]
