This seems to be in direct contradiction to the Department of Labor guidelines on the issue, found in Chapter 10 of its Field Operations Handbook, however, which states that the DOL will not consider graduate student assistants on stipend to be employees of the university, regardless of how many hours they work, as long as their work is related to their research or otherwise in furtherance of an educational objective.
