  The main theory that the plaintiffs were able to come up with involved that last-refuge-of-a-scoundrel Restatement section, §324A “Good Samaritan” liability, that would have:  (1) required publishers to investigate the substantive validity of everything they publish (the Philadelphia case involved clinical trials), and (2) would have placed anyone who published anything about a drug, no matter how limited, under a duty to research and publish everything.
