However, no moves were made post-Avena to incorporate the VCCR into domestic law—or at least no serious moves—and in the case of Medellin v Texas, some three years ago, the US Supreme Court had found that it could not prevent Texas from executing someone whose VCCR rights had not been violated as there was no federal law incorporating the Convention that Texas was bound to give effect to.
