I'm seriously confused.Is the Court of Appeal really saying that if both sides (i.e., the defendant and the People) recognize that (1) you're obviously guilty of the offense (i.e., you did it), but (2) you're also obviously insane (i.e., could not recognize right from wrong at the time of the crime), you can't agree to that as part of a plea deal? You can tell this case took a long time to work its way through the criminal justice system because one of the principal issues on appeal is whether it was permissible to introduce the alleged gang member defendant's MySpace page at his trial.I'm not thinking that there are many "original O.G.'s" with MySpace pages anymore.Even fewer after this opinion. But now that I've read it, when the prosecutor politely sends me a letter asking me to voluntarily show up to court in order to save the state the time and hassle of arresting me, I'm definitely going to tell them to pound sand. [read post]
