And I'm not sure how you'd have the current standard and the availability of the (s)-sounds like she thinks the existence of the (s) would change the standard, and wouldn't it do so even if the plaintiff did use the (s), because the plaintiff would be challenging a use without the (s) and thus have a decreased likelihood of confusion?
