Given that the State government officials sued -- the Governor, the Attorney General, and the State Registrar -- do not themselves administer the issuing of marriage licenses, one has to question whether there was even federal jurisdiction for Judge Walker to proceed in the first instance -- especially since those officials declined to defend the validity of Proposition 8.
