The former wife disagreed, and filed a petition with the Tax Court, arguing that the payments did not constitute alimony for federal income tax purposes.The Tax Court agreed with the former wife, reasoning that because the payments were not scheduled to stop if either former spouse died they did not meet the requirement of section 71(b)(1)(D) that there be no liability to make the payment for any period after the death of the payee spouse.
