Despite Kentucky's strong public policy against selling causes of action, the Sixth Circuit says that it's ok for the bankruptcy trustee to sell the debtor's claim against the attorney because the cause of action is property of the estate and the bankruptcy code, which trumps Kentucky law, gives the trustee the right to sell property of the estate.But what makes this particularly onerous is that the trustee sold the cause of action to the attorney/defendant's malpractice… [read post]
