It strikes me that the best criticism of the order is that the executive branch is expanding the reach of Title VI, and has been since the Bush II administration, without either Congressional action or at least a formal rulemaking process that would allow public objections during the notice-and-comment period and also litigation against whatever winds up being published in the Federal Register.
