According to the engineers, since the watchmaker had consented to the registration of the trade mark it was precluded by the Trade Marks Act 1994, s.5(5): "Nothing ... prevents the registration of a trade mark [on relative grounds] where the proprietor of the earlier trade mark or other earlier right consents to the registration".  After receipt of the cease and desist letters, the organization is still using the marks with "Xs" on them (sometimes, but apparently with some advice of trademark and copyright counsel) and includes a nice list with reproductions of all of the cease and desist letters its received thus far, here (which includes apparently truthful statements about their relationship with those companies).
