In the wake of the recent cyberattack on Equifax resulting in the possible disclosure of the personal data of over 150 million consumers, on September 18, 2017, New York State announced the issuance of proposed New York State Department of Financial Services (DFS) regulations that would require consumer credit reporting agencies to register with the DFS. A group of 96 organizations and individuals, who describe themselves as consisting of “consumer, labor, civil rights, legal services, faith, community and financial organizations and academics,” have sent a letter to the CFPB urging the Bureau to regulate fee-based earned wage access (EWA) products as credit subject to the Truth in Lending Act.
