The Appellate Division unanimously affirmed the lower court's ruling.The Appellate Division, conceding the status of the Port Authority as an interstate compact agency, explained that in Agesen v Catherwood, 26 NY2d 521, the Court of Appeals held that the Port Authority is still "subject to New York's laws involving health and safety, insofar as its activities may externally affect the public.
