Unless the appropriate regulator uncovers that fact in the course of an examination, or a problem arises in the course of the relationship between the bank and the vendor that causes the bank to focus on the contractual provisions (especially the warranties, remedies, limitations of liability, and disclaimers), they'll all sit there fat, happy, and legally exposed.
