As this W$J article from yesterday notes, the deal ended being structured with "only" $20 billion in bank debt rather than $25 billion (with Blackstone pitching in $6 million in equity), but that really didn't change the fundamental of the deal much. [read post]

Rev. 785, 803 (1988) (citing piracy as the "archetypal universal crime"), and federal courts have historically accepted the notion that a pirate may be tried by any state, see Smith, 18 U.S. at 176 ("piracy . . . is an offense against the universal law of society, a pirate being, according to Sir Edward Coke, hostis humani generis [an enemy of the human race]") (quoting 4 Blackstone's Commentaries *71, 73). Nonetheless, the use of acquitted conduct in sentencing is sufficiently counterintutive -- at least to Judge Fletcher -- to compel a dissent.Judge Fletcher's dissent has some pretty good lines, and uses Blackstone and others to highlight the significance of a jury's verdict and the dangers that arise from the rejection of that verdict in sentencing.
