He cited as an example Home Secretary v AF [2009] UKHL 28, in which Lord Hoffman said (paragraph 70), agreeing that AF’s appeal had to succeed because of the European Court’s ruling in A v UK, that I do so with very considerable regret, because I think that the decision of the ECtHR was wrong and that it may well destroy the system of control orders which is a significant part of this country’s defences against terrorism.
