They need a lawyer who will listen to them, and who will be open minded, and who will then tell them honestly before the show that they think the judge is never going to buy this, or that there is a risk they won’t (as appropriate) – and who will go on and run their case to the best of their ability based on informed instructions from a client who knows the risk.
