If judges purport to care about history, then historians (not to mention the public) are justified in demanding that judges do history properly, respecting the craft and method of the discipline rather than treating it as a do-it-yourself exercise in scrolling through The Federalist or plucking phrases like “equity” or “removal” out of cases with little regard for context.
