Certainly a greater emphasis on the letter might have made a difference in this case – in MG v DPP [2007] 2 IR 738 the Supreme Court allowed the applicant’s appeal and granted the order of prohibition on the grounds of exceptional circumstances, based on a finding that the complainant was attempting to use the criminal courts as an instrument of blackmail, as a “means of extracting money” from the accused.
