The New York State Court of Appeals held that the City of New York is required to pay up to the statutory cap for any health insurance plan it offers to its employees and retirees.The Court did not reach the question of how the statutory cap should be determined, explaining that "the City has not demonstrated that the question was preserved, and its answer depends on 'further evidence' not presented on the record below.
