Johnson, a decision overturning a Texas anti-sodomy statute in 2005, Justice Anthony Kennedy cited a European Court of Human Rights decision, as well as other international decisions, in justifying the majority's ruling striking down the state statute.Prior to Johnson, Justice John Paul Stevens had used a foreign citation in a footnote in a decision where the Court banned the use of the death penalty for mentally disabled criminals.
