Quinn (II), the Seventh Circuit in 2010 directed that state laws regarding primary procedures that stood in the way of holding a vacancy-filling election could and should be disregarded, but the court at the same time affirmed what it had said a few month earlier (when the case was before the Seventh Circuit on a different issue) to the effect that state law properly controlled the timing of any vacancy-filling election.
