Most recently, HTC obtained a stay from the England and Wales Court of Appeal, enabling it to ship all of its products into the UK market during the appellate proceedings following Nokia's recent win of an injunction over a hardware patent the court found various HTC devices incorporating Qualcomm and Broadcom chips to infringe.Over time Nokia asserted an increasing number of patents against HTC, and it brought lawsuits in additional jurisdictions. At close of business on Wednesday, the United States International Trade Commission (USITC, or just ITC) announced its decision to grant HTC's petition for review of a preliminary ruling according to which the Taiwanese device maker infringed two Nokia hardware patents due to the incorporation of Qualcomm chips into its products. Based on how the Friday trial went, I think HTC is more likely than not to win a German injunction against Nokia devices incorporating the Qualcomm Snapdragon chip, though the leverage this gives HTC will depend on whether the court agrees with its preferred or merely its alternative infringement theory.
