To play “devil’s advocate” for a moment, while it certainly makes sense for state agencies to determine as a matter of policy (and, perhaps, environmental impact) whether their projects’ use of energy is “wasteful, inefficient, and unnecessary,” it is less clear that it makes sense to extend such an amorphous and undefined standard to all private projects that require governmental approvals.
