As I detail in my Boston University Law Review article, (Un)Reasonable Royalties, one of the big problems with using the hypothetical negotiation for calculating damages (aside from the fact that it strains economic rationality and also has no basis in the legal history of reasonable royalties) is differences in bargaining power.
