The Court held that the draft agreement was incompatible with the EU treaties because it would deprive Member States' national courts of the power to refer questions of EU law to the CJEU for preliminary ruling under Article 267 TFEU and, if a decision of the unified patent court were to be in breach of EU law, it could not be subject to infringement proceedings by the Commission nor could it give rise to financial liability on behalf of EU Member States.
