The Supreme Court has handed down a decision in the Cartier case finding that internet service providers (“ISP’s”) do not have to bear the costs of implementing a blocking injunction pursuant to section 37(1) of the Senior Courts Act 1981, the statue requires ISP’s to block access to sites which sell goods that infringe upon trade mark rights.
