You could make the case that in a small county jail or typical medium security prison you would include cells for solitary isolation and never keep anyone in them for more than 15 days – although I'd be very careful with prison authorities promising to hold themselves to humane standards – but a large supermax prison is a completely different case. As I read it, Duncan's bill creates a two-county pilot, while Zerwas' legislation sets a more generalized rule allowing counties to perform competency restoration in jail instead of at the state hospital.Normally I'd say performing mental health treatment in jails instead of hospitals is a bad idea.
