This decision is interesting to the AmeriKat in light of Henry Carr J's recent decision in Evalve & Abbott v Edwards Lifesciences [2019] EWHC 1158 in May where it was made clear that the preliminary injunction test is a series of gateways (see Kat report here). [read post]

  The decisionHenry Carr J refused to grant Abbott a preliminary injunction on the basis that any irreparable prejudice that Abbott might suffer as a result of Edwards' limited launch was "clearly outweighed" by the irreparable harm that would be suffered by Edwards if the preliminary injunction was granted.
