"No matter how often Ericsson, Nokia, Qualcomm etc. stress that cellular SEPs are typically licensed at the level of handsets and not chips (because of those companies and others doggedly refusing to license baseband chipset makers, except that Qualcomm is more equal than others and secures such licenses for its own baseband chips), the natural choice would still be to license as high up in the value chain as possible. It will be interesting to see how they address the issue of component-level licensing in Nokia's automotive SEP cases.The appeals court in Munich also impressed me on a couple of occasions this year, but can't really solve the problem that too few cases (only about 10%, which is an insanity considering that the vast majority of patents are invalid as granted) get stayed there pending a validity determination. It clearly is--otherwise we'd have heard about problems with the performance of all those license agreements.I voiced criticism as well, but realized that Avanci was unstoppable after Daimler's settlement with Nokia last year, which showed that in the end it was just about money, not principle. I'm underwhelmed by that petition because it doesn't address the real issue, which is the absence of harm as Conti never faced a SEP infringement action by the likes of Nokia, and Conti's customers are free to take a car-level license (as some of them, such as Daimler and Volkswagen, already have).
