In finding the latter violation, the judge relied on Advanced Stretchforming International, 323 NLRB 529 (1997), enfd. in relevant part 233 F.3d 1176 (9th Cir. 2000), on remand 336 NLRB 1153 (2001), where the Board held that a successor employer, who violates Section 8(a)(1) by telling employees that there will be no union, forfeits a successor's normal right to set initial terms and conditions of employment.
