Let's face it: if a defendant wants to get a mileage in the infringement proceeding (i.e., increase the likelihood of a stay) out of a preliminary opinion by the Federal Patent Court that casts serious doubt on the validity of the patent-in-suit, that defendant's counsel will be sure to file the German equivalent of a U.S. request for judicial notice anyway.
