That doctrine was developed in Bulli Coal Mining Co v Osborne [1899] AC 351 which found that limitation would not be applied “in the case of concealed fraud, so long as the party defrauded remains in ignorance without any fault of his own” and also rejected the idea that “active concealment was essential”.
