You could make an argument that any offense shows that you're not able to "follow the rules" and hence there's a "link" between what you did and your constitutional right to represent yourself. [read post]

I get that in the old days, we might not have wanted posthumous child support filings because we'd want the father to be able to defend himself, and say (if true) that he wasn't the parent, which is hard when you're dead. [read post]

I have absolutely no problem with any of that.While they're doing all of this, they hear some dogs barking, see some dogs that appear to be fairly poorly kept up (when they peek inside the windows), and generally just get a sense that there might be something going on with respect to the dogs. Whereas the vast majority of courts (including the federal system) have adopted the "transactional" test for claim preclusion ("res judicata"), California has thus far stuck with the "primary rights" doctrine -- a relic of our common law past that's (at best) confusing, unhelpful and often substantially unjust.Nonetheless, that's the approach the California Supreme Court has elected to take.
