Aside from the question of the applicable level of constitutional scrutiny, scholars and industry players are also musing about the possibility of a Second Circuit ruling that Act 120 is unconstitutional in its entirety, perhaps as being unconstitutionally vague in violation of the First Amendment and Due Process Clause because it fails to provide reasonable notice of the scope of conduct that gives rise to civil penalties and authorizes arbitrary enforcement action.
