Writing for the majority, Justice Anthony Kennedy observed that although international law did not control the Court's analysis, it was both "instructive" and "significant" in interpreting the contours of the Eighth Amendment.The Roper Court noted that only seven countries had executed juvenile offenders since 1990: Iran, Pakistan, Saudi Arabia, Yemen, Nigeria, the Democratic Republic of Congo, and China.
