Hyundai argued that LV’s use wasn’t exclusive because two recording artists used LV marks in promotional images, but LV didn’t know about those until this case, and it had a record of aggressive enforcement against counterfeits, and the marks’ appearance in a video for My Humps and in a use by Tiffany led to a C&D and a royalty agreement.
