The well-known and much used defence arises from the 1999 case of Reynolds v Times Newspapers in which the House of Lords (now the Supreme Court) extended the defence of qualified privilege to cover the media. [read post]

The view of the learned editors of Duncan & Neill (Duncan and Neil on Defamation (Butterworths, 3rd edition, 2009), at 17.26. is that it can but the better view, which was assumed to be the case by at least two of their lordships in Reynolds (at 201 and 193-5 per Lord Nicholls and 237-8 per Lord Hobhouse.) is that it cannot.
