Following Omar v Westminster City Council [2008] EWCA Civ 421, Mohammed v Hammersmith and Fulham LBC [2001] UKHL 57 and Sahardid v Camden LBC [2005] HLR 11, a review of suitability must take account of facts as they are at the date of review, but on discharge of duty the review was limited to the position at the time of the original decision.
