The California US District Court agreed with Pierce that the counterclaim was not “core”, notwithstanding §157(b)(2)(C), because (in essence) it was not a “mandatory” counterclaim to the Pierce Proof of Claim (i.e., arose from different facts and occurrences), & treated the bankruptcy court findings and judgment as “proposed”[2].
