The two main questions in deciding whose interest had priority, and the questions to be considered by the Supreme Court, are: whether NEPB had been in a position, at the exchange of contracts, to confer equitable proprietary rights on Mrs Scott, as opposed to personal rights only; and if equitable rights were conferred, whether the decision of the House of Lords in Abbey National Building Society v Cann [1991] is to be applied.
