It's not on topic for this blog, but I thought my readers would be interested in another type of record company overreaching being shot down, the spurious claim that they could use the copyright laws to prevent an eBay seller from selling promo CD's because they had a sticker that they could not be resold. If this case comes to trial, it will be interesting to see if the RIAA manages to get a jury where no one has a digital music player with ripped music on it, or has ever recorded music on to cassette from the radio. [read post]

It therefore seems reasonable to suggest that American Cyanamid should never be followed so methodically that it produces a result so apparently inequitable.If you've not yet worked out the title, "While AC says BC, CD beats AB" means "When American Cyanamid says 'Balance of Convenience', CD (the anonymised respondent) beats AB (the anonymised applicant).
