In Freeholders of 69 Marina v Oram [2011] EWCA Civ 1258; [2012] H.L.R. 12, (link to our note) the Court of Appeal held that this sort of clause would usually allow a landlord to recover legal costs incurred in proving a breach of covenant (e.g. obtaining a judgment for service charge arrears).
