Not touching on the copyright issue, though I do believe that in the life of the author + 70 years it will be a moot point :), but at Seton Hall Law we explicitly state in our Exam Policy Page that laptops (and any other multimedia/electronic tablet/smartphones, etc) are NOT considered Open Book Exam Materials and that a laptop's only purpose in an exam room is to type in the exam software (SecurExam in our case).
