 In the Drake case, the Merit Systems Protection Board weakened or qualified the rights of federal employees to blow the whistle on violations of law in a manner consistent with prior Circuit Court rulings on gross mismanagement; however, the Federal Circuit in Drakereversed the MSPB and upheld the right to blow the whistle on violations of law without the qualifications urged by the MSPB and federal agency management.
