History teaches that governments for various reasons may be unwilling to make such a concession no matter the intensity of the violence and degree of organization on the part of the non-state party, and for that reason it has long been thought an admirable humanitarian innovation to have the field-of-application test turn not on such formalisms but instead on the actual facts-on-the-ground, taking the question out of the hands of interested parties.
