Lords Nicholls and Hope accepted a claim in unjust enrichment, of which the best explanation is that the Government was enriched by the “inevitable expense” of borrowing the funds it unlawfully collected as taxes, and that enrichment was measured by the compound interest the Government would have to pay in the market (which is lower than what a commercial party pays).
