Given that the facts Ruckman reports show that (1) the president signed a document saying he hereby gave a full and unconditional pardon to Toussie; (2) that that document was sealed; and (3) that the Office of the Pardon Attorney notified Toussie (or his counsel) that Toussie had been pardoned (not that he would be), I think it is fair to say that for all intents and purposes, this pardon had been signed, sealed, and delivered. Indeed, even at the federal level, pardons are generally handled through the Office of the Pardon Attorney, except of course, when they're not.It's clear from Article II and Supreme Court precedent that the President has the power to pardon on whatever grounds he deems appropriate, regardless of the criteria and advice of the Department of Justice. With respect to the number of pardons, we find that democratic presidents (who we expect to be less tough on crime) are more likely to grant pardons; that the crime rate has a negative impact on pardons; and that the number of pardons increased during Prohibition and during wartime and postwar periods.I wonder if anyone who has worked in the "Office of Pardon Attorney"--which must be the de facto decision maker for most… [read post]
