 There's no way the voters thought that a guy who uses a wirecutter to snip off sensor tags has should invariably stay in prison for life whereas a guy who snips 'em off with his bare hands should be let go.Just not plausible. [read post]

  It simply seems like it's rebutted in situations in which, as here, everyone agrees that the impropriety resulted in (1) an acquittal on an offense that lots of jurors thought the guy was guilty of, and (2) a conviction in which all the jurors already thought the guy was guilty (and a portion of whom were merely hoping to convict on a greater offense).The case that Justice Robie cites for prejudice in this context is People v.  The state wants a retrial on a strike, but there's no need to waste money doing so, since the net result (even if the state was successful on remand) would be to add a single day to the guy's already-existing 39 year sentence.Makes sense to me. [read post]

It's a close call as to which of the following I'd prefer: (1) to be a famous guy in history, or (2) to be a famous guy in history for whom a disputed holiday is named and that results in my name being taken in vain by a significant fraction of the population every year. [read post]
